These Terms of Service ("Terms") govern your access to and use of the NestShot mobile application and any related services (collectively, the "Service") provided by NestShot ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old to use NestShot. By using the Service you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
NestShot creates a unique anonymous user account for you automatically when you first open the app — no email address or password is required to get started. You are responsible for maintaining the security of your device, as access to the app constitutes access to your account.
If you choose to provide a display name, you agree not to use a name that impersonates another person or is otherwise misleading.
NestShot operates on a credit-based model. Credits are consumed when you use AI processing features (Clean Photo, Empty Photo, Restage). Viewing, saving, sharing, and watermarking photos do not consume credits.
Subscriptions are billed in advance on a monthly basis and renew automatically until cancelled. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms. We do not process payments directly.
Except as required by law, all purchases are final and non-refundable. If you believe a charge was made in error, please contact us at hello@nestshot.com.
You retain full ownership of all photos and other content you upload to NestShot ("User Content"). By uploading User Content, you grant NestShot a limited, worldwide, royalty-free licence to store, process, and display your content solely for the purpose of providing the Service to you.

All rights in the NestShot application, including its design, software, trademarks, logos, and AI models, are owned by NestShot or its licensors. Nothing in these Terms transfers any of those rights to you. You receive only a limited, non-exclusive, non-transferable licence to use the app for personal or professional real estate purposes.
AI-generated images produced by the Service may be used freely by you for your property listings and marketing materials. We make no claim of ownership over AI outputs generated from your content.
NestShot's AI features are provided on a best-efforts basis. AI outputs may occasionally contain artefacts, inaccuracies, or results that do not meet your expectations. We do not guarantee that every processed image will be suitable for professional use. You are responsible for reviewing all AI outputs before publishing or sharing them.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or applicable law, or if we discontinue the Service. You may stop using the Service at any time. Upon termination, your right to use the Service ends immediately. Sections 4, 6, 10, and 11 survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NESTSHOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NestShot is incorporated, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of that jurisdiction.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. If the changes are material, we will provide notice through the app or via email where we have your contact information. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
